Accepting these terms

These terms are an agreement between you and the developer of Capy Boom: Cannon Smash ("the game", "we", "us"). By downloading or playing the game you accept them, together with our Privacy Policy. If you do not agree, please do not use the game. The terms of the store you downloaded the game from (Google Play or the Apple App Store) also apply.

Age

The game is intended for players aged 13 and over. If you are under the age of majority where you live, you may make purchases only with the permission of a parent or guardian.

Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own non-commercial entertainment. You may not copy, modify, sell, rent or redistribute the game or any part of it.

Coins and virtual items

• The game contains virtual items such as coins, boosters, extra lives and cannon skins, which you can earn by playing or buy with real money.
• Virtual items are a limited licence to use content inside the game. They are not property, have no monetary value and cannot be sold, transferred or exchanged for real money or anything outside the game.
• Your progress and items are stored on your device. Uninstalling the game or clearing its data may remove them, and we cannot restore items lost this way, except permanent purchases such as No Ads, which can be restored with "Restore Purchases" in the settings.
• We may change the balance, prices or availability of virtual items in updates.

Purchases and refunds

In-app purchases are processed by Google Play or the Apple App Store, and their payment terms apply. Purchases are final once the item has been delivered, except where the law of your country or the store's policy gives you a right to a refund. To request a refund, use Google Play or Apple's Report a Problem. If a purchased item did not arrive, write to us and we will help.

Fair play

You agree not to cheat, use bots, hack or reverse-engineer the game, exploit bugs, interfere with its servers or services, or obtain items in ways the game does not offer. We may reset progress or items obtained this way.

Ownership

The game, including its characters, art, music, sounds, levels and code, is owned by us or our licensors and protected by copyright and other laws. Nothing in these terms transfers any of these rights to you, apart from the licence to play described above.

Updates and availability

We may update, change or stop offering the game or any of its features at any time. Some updates may be required to keep playing.

No warranty

The game is provided "as is" and "as available". To the extent allowed by law, we make no warranties that it will be uninterrupted, error-free or suitable for any particular purpose.

Limitation of liability

To the extent allowed by law, we are not liable for indirect, incidental or consequential damages, or for the loss of data or virtual items, arising from your use of the game. Our total liability is limited to the amount you paid us for in-app purchases in the 12 months before the claim. Nothing here limits rights you have under consumer protection law that cannot be waived.

Governing law

These terms are governed by the laws of Ukraine, without prejudice to the mandatory consumer protection laws of the country where you live.

Changes

We may update these terms. The new version will be posted on this page with a new effective date, and continuing to play after that means you accept it.
